Morning Bell: The Five Generals -"Dissenting in yesterday’s 5-4 Boumediene v. Bush decision, which found the subsequent Military Commissions Act of 2007 unconstitutional, Justice Antonin Scalia retorts: “Turns out they were just kidding.” The entirety of Scalia’s dissent is a must read for anyone who cares about the lives of American soldiers and the separation of powers, but here is a quick condensation"

Detention of the Enemy During Wartime-"Even when parts of the law of war do not apply, they are persuasive, and the United States has chosen to adhere to or surpass the requirements of the law of war even when it was under no obligation to do so. This web site presents in one place the legal authorities under girding U.S. detention policy, from international law and the Geneva Conventions to Department of Defense directives and Army regulations and procedures, and explains how they fit together in practice as the U.S. wages the war on terrorism. Its goal is to foster and stimulate informed debate about a topic too often subject to partisan quarrelling and misinformation."

Conservatives Try Again to Delay Calif. Same-Sex Marriages-"However, "the Supreme Court cannot rewrite statutes and cannot remove language from the statutes; such must be done by the legislature," the organization noted in its motion. "The power to write laws belongs to the people and political branches of government, not the judiciary.""Hundreds of laws apply to marriage, but the Supreme Court addressed only two," said Mathew Staver, founder of Liberty Counsel and dean of Liberty University School of Law. "It is inconceivable that by striking down two statutes, the myriad of other marriage laws are automatically changed."Since neither the Supreme Court nor the Court of Appeal has declared unconstitutional the myriad of other statutes regarding marriage, local government officials do not have the power to issue marriage licenses until the legislature addresses these statutes," Staver added."

Chief Justice of the Ninth Circuit caught with photos of bestiality-"The paper discovered that Judge Alex Kozinski, who was presiding over a lower court obscenity case, had something in common with the suit's defendant. They both have an affinity for hard-core pornography. In a revelation that is shocking the legal community, Kozinski posted on a personal website nauseating photos of bestiality, striptease, transsexuals, and other images too graphic to describe. When confronted by the Times, Kozinski said that the photos were for his private use and he was unaware the content could be viewed by the general public. "Is it prurient?" Kozinski asked yesterday. "I don't know what to tell you... It's part of life.""

Update: Federal Judge Declares Mistrial over His Own Porn Site-"Judge Alex Kozinski of the 9th U.S. Circuit Court of Appeals has declared a mistrial in an obscenity case after he admitted hosting a private Web site that contains pornography. He recused himself, and said he would ask a court to reassign it."

Fox News hires Mike Huckabee-"I hope to bring the unique perspective from `inside the dragon's belly' as well as to try and speak for the millions of hardworking middle-class Americans who really do feel that their voices are not being heard," Huckabee said in a statement released by his daughter, Sarah. "I saw that on the campaign trail and continue to see as I speak to groups of all kinds around the country as well as campaign for other candidates.""
