Battle for Florida Marriage Amendment Heats Up-"Orlando, FL - Florida Red and Blue, a front group for the radical homosexual agenda which opposes Amendment 2, the Florida Marriage Protection Amendment, is in a panic as we head to the polls on Tuesday. The group filed a frivolous lawsuit against several people and organizations, including Florida4Marriage.org (the official sponsor of the Amendment), Florida Family Policy Council, Florida Family Action, John Stemberger and Tom Messer.
The attorney representing Florida Red and Blue is Benedict P. Kuehne, who was indicted in February 2008 on charges of conspiracy, money laundering and obstruction of justice, seeking more than 5 million dollars in forfeiture. The federal indictment of Kuehne and two others from Medellin, Columbia, alleges that Kuehne funneled drug money through his law firm trust account from Fabio Ochoa Vazquez (one of the world’s largest cocaine traffickers and a leader of the Medellin Cartel). If convicted, Kuehne could face 20 years in prison and a $250,000 fine, in addition to the forfeiture.
The lawsuit filed by Kuehne alleges election law violations. Florida Red and Blue's complaint, filed at the Florida Division of Elections, has already been dismissed. Even though Florida law does not allow a private cause of action, Florida Red and Blue retained Kuehne to file this frivolous lawsuit anyway. Liberty Counsel is representing the defendants and will be in court later today in Miami seeking sanctions against Florida Red and Blue.
From the beginning, advocates of same-sex marriage have tried to keep the people from voting on the marriage amendment. The ACLU filed suit in 2005 seeking to block the amendment. Mathew Staver, Founder of Liberty Counsel and Dean of Liberty University School of Law, argued the case at the Florida Supreme Court, which ruled 7-0 in favor of the Amendment. Florida requires a 60 percent margin to pass Amendment 2. The polls show that Amendment 2 is polling close to 60 percent, but the best indicator shows that no more than 34 percent have opposed it. Fearing they will lose, Florida Red and Blue has resorted to lies and frivolous lawsuits.
Other marriage amendments on the ballot tomorrow include Proposition 8 in California and Proposition 102 in Arizona.
Commenting on the marriage amendments, Staver said: "The future of marriage and the well-being of our children are on the line tomorrow. Same-sex marriage advocates have resorted to lies and frivolous lawsuits to prevent the people from having a voice in this important matter. Despite their frantic attempts to bypass the people, the people will vote 'Yes' on marriage."

Lawsuit against marriage amendment leaders dismissed -"A lawsuit alleging election law violations filed against leaders of the coalition backing Amendment 2, the Florida Marriage Protection Amendment, was dismissed late Monday by a Miami judge.
According to a news release from John Stemberger, chairman of Florida4Marriage.org, the coalition working for passage of Amendment 2, the lawsuit sought to freeze the marriage campaign bank accounts and remove all television ads for alleged violations of Florida election law.
The lawsuit was filed by Florida Red and Blue, a pro-homosexual rights organization opposing Amendment 2.
Liberty Counsel attorney Harry Mihet represented Stemberger and various organizations he leads. Stemberger reported the court issued an oral ruling denying all counts of plaintiff's motion and found there was no basis for an emergency hearing, no basis for injunctive relief and no likelihood of success on the merits of the claim."
South Dakota Ballot Measure 10
Ballot measure 10 in South Dakota-"A South Dakota ballot campaign is designed to stop government officials from using tax dollars for lobbying or political campaigns that go against Christian faith and values.
Attorney Stephen Wesolick, who is affiliated with the Alliance Defense Fund, has played a major role in getting the measure on the South Dakota ballot. "One of those groups would be, for example, the National Education Association [NEA], which in South Dakota in 2006 campaigned or contributed to the campaign against our Amendment C, which was our marriage amendment defining marriage as between one man and one woman," he explains. The NEA has made major contributions to defeat California's Proposition 8, which would overturn the court-ordered legalization of homosexual "marriage" in that state. "Of course, the NEA is viewed by many people as a radical leftist organization that, in many states, requires compulsory payment of membership dues in non-right-to-work states," he adds. Wesolick is hopeful voters will agree on Tuesday that organizations should not be permitted to receive tax dollars and then use the money to lobby lawmakers and to sway voters in an election.
