Brazilian Supreme Court Rules that Sex With Children Not Necessarily a Crime - Denounced by United Nations-"By Matthew Cullinan Hoffman, Latin America Correspondent

SAO PAULO, June 7, 2009 (LifeSiteNews.com) - The Brazilian Supreme Court and a lower appeals court have nullified two sentences against child sex abusers in recent months on the grounds that their behavior did not constitute a crime under Brazilian law, sparking a protest from the United Nations.

On June 23, Brazil's Superior Tribunal of Justice (the nation's Supreme Court for cases not involving Constitutional law) upheld the acquittal of several men who had paid two girls, 12 and 13 years of age, to have sexual intercourse with them, on the grounds that prostitution was not covered by child sex abuse statutes.

The men, one of whom has been identified as a Brazilian sports celebrity, reportedly took photos of the encounter.

Although the fact that the men engaged in sexual intercourse with the girls was apparently not in doubt, the Tribunal of Justice of the state of Mato Grosso do Sul had ruled that it was not a crime, because the girls were engaged in prostitution. Brazil's Superior Tribunal agreed, upholding the lower court ruling.

"The prostitutes waited for the client in the street, and are no longer people who enjoy a good image in society," the judge ruled in the original case, adding that "prostitution is such an old profession and is considered to be barely a moral abuse, but never a crime subject to penalty."...Click link to read more

Chief U.S. Judge Slapped on Wrist for Bestiality, Porn on Personal Website

LOS ANGELES, California, July 8, 2009 (LifeSiteNews.com) - Peers have admonished and cleared Chief Judge Alex Kozinski of the 9th Circuit Court of Appeals for showcasing images of bestiality and other sexually explicit material on his personal website.

The images were discovered last year as Kozinski presided over an obscenity trial, from which the judge recused himself after the prosecutor in the case petitioned for time to investigate "a potential conflict of interest concerning the court having a ... sexually explicit website with similar material to what is on trial here."

Kozinski was found to have published on his site images of a half-naked man "cavorting" with a sexually aroused farm animal, naked women painted as cows, and other extremely graphic material including images of masturbation and public sex.

In a June 2008 interview, Kozinski indicated that he did not consider the images obscene, and claimed he did not know the website's material could be accessed by the public.

"Is it prurient? I don't know what to tell you," Kozinski told the Los Angeles Times. "I think it's odd and interesting. It's part of life."

A panel of Third Circuit judges asked to investigate the complaint settled upon a public admonishment as sufficient disciplinary action, together with Kozinski's previous apology and his removal of the offensive material.

"His conduct exhibit(ed) poor judgment," wrote Chief 3rd U.S. Circuit Judge Anthony J. Scirica. "Moreover, once the Judge became aware in 2007 that offensive material could be accessed by members of the public, his inattention to the need for prompt corrective action amounted to a disregard of a serious risk of public embarrassment."

The panel called Kozinski "careless" and "judicially imprudent" in possessing and failing to safeguard "his sphere of privacy."....Click link for more

"Victory": Assisted Suicide Amendment Defeated in British House of Lords

WESTMINSTER, July 8, 2009 (LifeSiteNews.com) - Pro-life campaigners in Britain yesterday welcomed a reprieve in the battle against euthanasia as a bill that would have legalised assisted suicide was defeated in the House of Lords. In a vote of 194 to 141, an amendment to the government's Coroners and Justice Bill was defeated last night that would have sanctioned assisted suicide in the UK and facilitated Britons going overseas to commit suicide.

The amendment had been put forward by Charles Falconer, a former Lord Chancellor and major figure in Tony Blair's New Labour and part of a cadre of euthanasia campaigners at Westminster. Under current UK law, it is illegal for someone to assist another to commit suicide, even if done out of the country. The chief prosecutor, however, has instructed police to turn a blind eye to violations in the latter case.

Paul Tully, general secretary of the Society for the Protection of Unborn Children called the defeat of the bill a "significant victory for the right to life."....Click on link for more
